Privacy Policy

1. Who We Are and Scope

ClearValue Lending ("ClearValue," "we," "our," "us") is a funding platform that helps small business owners apply for funding through our network of evaluated lender partners. We are not a lender, broker, or financial advisor — those functions belong to our lender partners. This Privacy Policy explains how we collect, use, share, and protect personal information when you visit clearvaluelending.com, the on-site application portal, or otherwise interact with our services (collectively, the "Services").

Our Services are intended for U.S.-based business owners and authorized representatives applying for commercial financing on behalf of a business. We do not knowingly collect information from individuals applying for consumer credit or from anyone under 18.

2. Information We Collect

We collect the following categories of personal information. Categories marked [Sensitive PI] are treated as "sensitive personal information" under the California Consumer Privacy Act (CCPA/CPRA) and analogous state laws, and you have the right to limit our use and disclosure of those categories as described in Section 8.

  • Identifiers — name, email address, phone number, mailing address, IP address, device identifiers, and (during the application process) [Sensitive PI] Social Security number, driver's license number, state ID or passport number, and Employer Identification Number (EIN).
  • Business and commercial information — business legal name, DBA, industry, NAICS code, time in business, monthly revenue, bank statements, tax returns, debt schedule, and other underwriting documentation you submit.
  • Financial information [Sensitive PI] — bank account and routing numbers, deposit history, log-in credentials supplied to bank-statement aggregators, credit history, prior financing arrangements, and information returned by credit bureaus or verification services.
  • Internet and device activity — browser type, pages viewed, referring URL, session duration, approximate geolocation derived from IP address, and information collected through cookies and similar technologies (see our Cookie Policy).
  • Communications — content of emails, SMS, chat, or call recordings (where lawful and disclosed), and your communication preferences.
  • Inferences — derived signals about your business profile and product fit (for example, the estimated funding amount produced by our calculator).

3. Sources of Information

We obtain personal information from:

  • You directly, when you submit an application, complete a calculator, contact us, or interact with our website.
  • Funding lenders in our network, when they share underwriting decisions, offers, or transaction outcomes.
  • Consumer reporting agencies and business credit bureaus, when we or a lender pulls credit reports.
  • Identity verification, fraud prevention, and KYC service providers.
  • Public records and commercial data providers (for example, Secretary of State filings, UCC databases).
  • Cookies, pixels, and analytics providers operating on our website.

4. How We Use Your Information

We use the information we collect to:

  • Evaluate your application and match you with lenders likely to fund your business.
  • Share your application with funding lenders for their underwriting and pricing.
  • Verify your identity and the existence and standing of your business, including as required under the Bank Secrecy Act, the USA PATRIOT Act, and applicable customer-identification, anti-money-laundering, and know-your-customer requirements imposed on us or our Funding Lenders.
  • Detect, prevent, and respond to fraud, abuse, or security incidents.
  • Operate, maintain, secure, and improve our Services.
  • Communicate with you about your application, your account, and customer support matters.
  • Send you marketing communications about our Services where you have provided required consent (see Section 9).
  • Comply with legal obligations, respond to lawful requests, and enforce our Terms of Use.
  • Aggregate or de-identify information for analytics, research, and product development.

5. How We Share Your Information

We share personal information with:

  • Funding lenders in our network, so they can underwrite your application and present offers. Once you receive an offer, you decide whether to accept; the funding agreement is between you and the lender.
  • Service providers we engage to host our infrastructure, process payments, send communications, deliver analytics, prevent fraud, and provide other operational services. These providers are bound by contractual confidentiality and security obligations.
  • Identity verification and credit reporting agencies, as needed to verify your identity and pull credit information with consent.
  • Professional advisors — our attorneys, accountants, auditors, and insurers — under duty-of-confidentiality protections.
  • Government authorities and other third parties, when required by law, subpoena, or other legal process, or to protect our rights, property, or safety, or the rights, property, or safety of others.
  • An acquirer or successor in connection with a merger, acquisition, financing, sale of assets, bankruptcy, or similar corporate transaction. We will use reasonable efforts to notify you of any such transaction.

We do not sell your personal information for monetary value. We may "share" personal information with advertising partners for cross-context behavioral advertising as those terms are defined under the California Consumer Privacy Act (CCPA/CPRA); see Section 8 for your opt-out rights.

6. Gramm-Leach-Bliley Act (GLBA) Notice

Because we collect financial information in connection with applications for commercial financing, certain of our practices may be governed by the Gramm-Leach-Bliley Act (GLBA) and related rules, including the FTC Privacy Rule and the FTC Safeguards Rule. We collect non-public personal information ("NPI") from your application, transactions with us and our lender network, and consumer and commercial reporting agencies. We share NPI only with our funding lender network, our service providers, and as otherwise permitted under GLBA's exceptions for joint marketing, processing, servicing, transferring servicing, or as required or permitted by law. To the extent we engage in non-affiliated sharing for purposes outside these GLBA exceptions, you have the right to opt out by emailing hello@clearvaluemoney.com with the subject "GLBA Opt-Out." We maintain administrative, technical, and physical safeguards to protect NPI consistent with the FTC Safeguards Rule and applicable state law.

7. Cookies and Tracking Technologies

We use cookies and similar technologies (pixels, web beacons, local storage) to operate the Services, remember your preferences, measure usage, and support marketing. 8. Your Privacy Rights

Depending on where you reside, applicable law — including the California Consumer Privacy Act/CPRA, Virginia CDPA, Colorado CPA, Connecticut CTDPA, Utah UCPA, Texas TDPSA, Oregon OCPA, Iowa ICDPA, Tennessee TIPA, Indiana CDPA, Florida FDBR, Montana MCDPA, Delaware DPDPA, New Jersey DPA, New Hampshire SB 255, Minnesota CDPA, Maryland Online Data Privacy Act, Rhode Island Data Transparency and Privacy Protection Act, Kentucky CPA, and Nebraska Data Privacy Act — may provide you the following rights with respect to your personal information:

  • The right to know what personal information we collect about you and to access a copy of that information.
  • The right to request deletion of personal information we have collected, subject to legal exceptions.
  • The right to correct inaccurate personal information.
  • The right to data portability, where applicable.
  • The right to opt out of "sales" and "sharing" of your personal information for cross-context behavioral advertising.
  • The right to limit the use or disclosure of sensitive personal information (including SSN, driver's license number, financial account log-in credentials, and similar data) to what is reasonably necessary to provide the Services you have requested. To exercise this right, email hello@clearvaluemoney.com with the subject line "Limit Sensitive PI."
  • The right to appeal a denial of a privacy rights request, where required by your state's law (Virginia, Colorado, Connecticut, and other states recognize this right).
  • The right to opt out of certain automated decision-making and profiling that produces legal or similarly significant effects, where applicable, and to non-discrimination for exercising your privacy rights.

To exercise these rights, email us at hello@clearvaluemoney.com with the subject line "Privacy Rights Request" and a description of the right you are exercising. We will verify your identity before responding. You may use an authorized agent to submit a request on your behalf, subject to verification. We will not discriminate against you for exercising your privacy rights.

California residents may also use the Do Not Sell or Share My Personal Information link in our footer or transmit a Global Privacy Control signal to opt out of "sales" and "sharing" as defined under the CCPA/CPRA.

9. Marketing Communications and Consent

If you provide your phone number through our Services and check the applicable consent box, you expressly consent to receive marketing and informational telephone calls and SMS/text messages from ClearValue Lending and our funding partners, including calls or messages delivered using an automatic telephone dialing system or pre-recorded or artificial voice. Message and data rates may apply. Consent to receive marketing communications is not a condition of any application or financing. You may opt out of SMS at any time by replying STOP, or unsubscribe from emails using the link at the bottom of any marketing email. See our Communications Consent for details.

10. Data Retention

We retain personal information for as long as reasonably necessary to provide the Services, comply with our legal, tax, accounting, and recordkeeping obligations, resolve disputes, and enforce our agreements. Application records and transaction records (including identifiers, business and commercial information, financial information, and sensitive personal information collected during the application process) are typically retained for at least seven (7) years after the last interaction or transaction, consistent with industry practice and applicable lender, banking, and tax regulations. Internet and device activity is typically retained for up to 24 months. Marketing-communications preferences and opt-out records are retained for as long as we maintain a relationship with you and for the period required to demonstrate compliance with applicable law. When information is no longer needed for these purposes, we securely delete or de-identify it.

11. Information Security

We maintain administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, alteration, disclosure, or destruction. For more information, see our Security Statement. No method of transmission over the Internet or method of electronic storage is 100% secure, and we cannot guarantee absolute security.

12. Automated Decision-Making

Our website includes calculators and matching tools that use rule-based heuristics to estimate fit and approximate funding ranges. These outputs are estimates only and do not constitute approvals, offers, or denials of credit. Final credit decisions and pricing are made by the funding lenders in our network using their own underwriting processes. To the extent any decision regarding you is made through automated means without meaningful human review, you may have the right under applicable law to request human review or to opt out; please contact us at the address in Section 17.

13. Children's Privacy

Our Services are intended for adult business owners and authorized representatives. We do not knowingly collect personal information from children under 18. If you believe a child has provided personal information to us, please contact us and we will delete the information.

14. Third-Party Links and Services

Our Services may contain links to third-party websites and services, including the websites of funding lenders, that are not operated by us. This Privacy Policy does not apply to those third parties. We encourage you to review the privacy practices of any third party before sharing personal information with them.

15. International Users

Our Services are operated in the United States and intended for U.S.-based businesses. If you access our Services from outside the United States, your information will be processed in the United States, where data protection laws may differ from those in your jurisdiction.

16. Changes to this Privacy Policy

We may update this Privacy Policy from time to time. We will post the updated policy on this page and update the "Effective" date above. Material changes will be communicated through reasonable means, which may include posting a prominent notice on our website or sending email to the address associated with your account. Your continued use of the Services after changes become effective constitutes acceptance of the updated policy.
