Can I get an extension on my RFE deadline? +
USCIS does not grant extensions on RFE response deadlines. The 87-day (or shorter) deadline stated on the RFE is absolute. If you cannot gather all evidence in time, submit the best available evidence with an explanation — a partial response is better than no response.
Should I use an immigration attorney for my RFE? +
For employment-based petitions and complex family cases, an immigration attorney adds significant value — they know the evidentiary standards and how USCIS currently interprets regulations. What is a NOID vs. an RFE? +
A Notice of Intent to Deny (NOID) is more serious than an RFE. A NOID signals USCIS intends to deny unless you overcome their stated grounds. The response deadline on a NOID is typically shorter (often 33 days). Treat a NOID as an urgent legal matter.
Can I check my RFE response receipt online? +
Yes. Use the USCIS Case Status Online tool at uscis.gov/case-status to check whether your response was received. Always send RFE responses via a trackable mail method (USPS Priority Mail, FedEx, UPS) and keep the tracking confirmation.
